WESTERN CAPE:- Recent incidents have once again highlighted the importance of ensuring that employees have the correct legal work documentation.
A video currently circulating on social media shows a farmer being loaded into a police vehicle along with an undocumented worker. This is not an isolated case. Last year, a builder in Langebaan was fined R11,000 after authorities found 11 undocumented foreign workers on his premises.
According to the law, it is the employer’s responsibility to ensure that any worker they hire has the correct documentation to work in South Africa. Failure to do so can result in hefty fines or even arrest. Business owners, particularly in the agriculture and construction sectors, are urged to make copies of their workers’ South African IDs or valid work permits and store them safely.
An interesting perspective shared by some farmers and smallholding owners is that they sometimes prefer hiring foreign workers due to issues they have encountered with local workers, including theft. While this does not apply to everyone, some employers report high levels of crime among local employees. Unfortunately, this means that honest job seekers in the community also suffer from this perception. However, it is important to evaluate each worker on merit, and regular monitoring and security measures can make a positive difference.
For business owners, the solution is simple: comply with the law. Ensure your workers have legal documentation, keep records of their status, and operate responsibly to avoid potential fines or legal consequences. As law enforcement tightens regulations, it is wise to be proactive and ensure that your business remains on the right side of the law.
