Legal Aid, Broken Promises – And a Justice System That Ignores the Voiceless”

I’ve been through hell long enough now – which I don’t wish on anyone – where are the so-called human rights written into the country’s constitution?

From the cruel grip of apartheid to the failed promises of democracy, I’ve watched how the dream of equal rights for all has slowly faded into silence, neglect, and bureaucratic betrayal.

I am tired.
Tired of the blatant lies.
Tired of the empty promises from politicians.

Tired of the government departments that were created to protect the vulnerable, but now stand as lifeless buildings where cries for help go unanswered.

When South Africa entered democracy in 1994, we were filled with hope.

A new constitution.

New leaders.

New platforms.

 These were meant to ensure no one would suffer again because of their background or the colour of their skin.

One of those platforms was Legal Aid South Africa, an institution created to protect the rights and dignity of the poor, especially farm workers and those unable to afford private legal help.

It was supposed to defend our rights and help restore dignity.

But what remains of that noble vision today?

 Where Legal Aid Fails the People

In 2022, I personally accompanied five families, unlawfully evicted from a farm in Velddrif, to the Legal Aid office in Vredenburg. They were desperate. But nothing came of it, just vague excuses from the receptionist and no further contact.

These families lost everything, including personal belongings left behind in their homes after being kicked out. Not even the bare minimum was done to help them.

Across Wellington and Paarl, the same pattern repeats. Families who had lived for years on farms, often without electricity or running water, were forcefully removed. They contact me, I try to help them. Their pleas to Legal Aid offices fell on deaf ears.

In one shocking case, a farmer in Paarl began demolishing a woman’s home while she was still living inside.

Why?

Because she refused to leave.

There was no court order.

No lawful eviction process.

Just raw, unchecked force.

And again – Legal Aid did nothing.

 In my own town of Hopefield, a black family was evicted despite a valid High Court order in their favour.  The same  mother of the household was assaulted by the same white farmer, yet no police action followed.  I have had personal meetings with a Brigadier of the Police, along with a Lieutenant/Colonel of the NPA about the unfair treatment of the family, nothing has come of it.

Even meetings with the Human Rights Commission have come to nothing – is this the so-called democracy?

She had a Legal Aid lawyer – Still, no justice was served.

My Story: Betrayed by the System

In 2019, I sold my house to my daughter and her husband. The agreement was simple: they would pay R150,000 (less than the R300,000 I initially requested) and, in exchange, would build me a room and take care of my basic living needs, water, electricity, and sanitation.

None of that ever happened.

After month of broken promises and hardship, I was advised to cancel the agreement.  But in my vulnerable and emotional state, the same lawyer who represented them, tricked me into signing transfer documents, not cancellation papers. He was one of those advised me to cancelled the contract.

I believed I was undoing the sale, instead, I signed away my rights and my home.

When I discovered what had happened, I hired a new Black lawyer, who unearthed proof of tampered documents and false dates submitted to the High Court by the previous lawyer. But the court dismissed the matter outright, without reviewing the critical evidence.

They simply said – “The transfer is complete,” as if fraud and forgery mean nothing.

Ignored by the Courts – Forgotten by the System

I had actually forgotten about a will I signed with that same crooked lawyer, ask the same day I signed documents cancelled the sale of my house. Clearly bequeathing the house to my other daughter.

“That will be signed at his office in Vredenburg, with his staff handwriting, and carries his office stamp.

When my case was brought before the High Court on 28 October 2021, with representation from both a Black attorney and a Coloured advocate, we presented strong written evidence.

Still, the High Court ignored everything.

I could no longer afford private legal representation and turned to the Law Society for help. I handed them all my documents. But many of those documents mysteriously disappeared. Despite numerous follow-ups by email, I never received a single reply.

Once again, I placed the issue of fraud and unethical conduct by the lawyer on the table. And once again, it was swept aside. It felt like someone, somewhere, was being protected.

I was advised to appeal, but by then I had lost trust in the Law Society process. I turned instead to Legal Aid. Unfortunately, the Legal Aid lawyer assigned to my case was on holiday, and by the time she responded, crucial deadlines had passed.

Later, she informed me she had proof from the Master’s Office that the documents submitted to court were manipulated. She told me, “I’m just waiting for the full proof.”

That was in January this year.

Since then, I have heard nothing.

How Much Longer Must We Suffer in Silence?

I am 69 years old, i do not deserve to live like this, without basic services, without justice, and without peace of mind.  And neither do the families who are still being treated like stray dogs, chased off the land they helped build, simply because we live under a system that no longer protects us.

We cannot call this a democracy while corruption continues to replace accountability.
We cannot claim we are free while farmers act above the law and Legal Aid stands by in silence.
We cannot say we are equal while courts ignore the cries of the poor and the elderly.

I obeyed every unjust apartheid law in my youth. I waited for the dawn of freedom and equality.  And now, 30 years later, I must ask:

What has really changed?

I’ve had Black lawyers. I’ve had Coloured advocates. I’ve followed every lawful path. But even now, the justice system still denies me a fair hearing.

This is not just about me anymore; it is about every South African who believed in the dream of democracy – only to be abandoned.

I demand answers.
I demand justice.

And most of all, I demand that we start listening to the voiceless again.

This country cannot go on like this.
