Interpreter Blunders Raise Questions in High-Profile Trial

Saldanha Bay:- In the ongoing trial concerning the disappearance of six-year-old Joshlin Smith, the role of the court interpreter has come under intense scrutiny.

Observers have reported that the interpreter’s inconsistent and inaccurate translations have caused significant delays and raised concerns about the integrity of the proceedings.

During a recent session, the interpreter’s struggles with basic interpretations led to a five-minute adjournment to address the issue. Compounding the situation, the interpreter was overheard expressing dissatisfaction with his role, stating, “I’m not happy to be here” (“Ek het nie lus om hier te wees nie”) when his microphone was inadvertently left on during the break.

The importance of competent court interpreters cannot be overstated, as they ensure that all parties fully comprehend the proceedings, upholding the principles of justice. In South Africa, concerns about the proficiency of court interpreters are not new. A study highlighted that many interpreters are inadequately trained, leading to unprofessional conduct and potential miscarriages of justice.

In the context of the Joshlin Smith case, the interpreter’s shortcomings have tangible consequences. For instance, state witness Laurentia Lombaard became visibly distressed during cross-examination, with the interpreter noting that she was “shaking.”  Such observations, while potentially accurate, underscore the interpreter’s influential role in conveying not just words but also the emotional nuances of testimonies.

Given the high stakes of this trial, the court must employ an interpreter who can deliver precise and reliable translations. The current interpreter’s performance raises questions about the selection and training processes for such critical roles within the judicial system. Ensuring that interpreters are adequately trained and vetted is essential to maintain the integrity of legal proceedings and uphold public confidence in the justice system.

As the trial progresses, the court must address these interpreter-related issues promptly to prevent further delays and potential misunderstandings that could compromise the pursuit of justice for Joshlin Smith.
