Saldanha Bay:- The court has been adjourned, and this may mark the end of the Trial within a Trial.
“I will hear your arguments on Friday morning and deliver my ruling that afternoon. By then, everyone will have a sense of which way the wind is blowing on your respective cases.
Of course, it depends on how long the prosecution might still be. If they take longer, you may only proceed later in the afternoon.”
“Yes, My Lord.”
“I suspected as much. So, Mr. Harmse, it appears you might have to argue your case tomorrow.”
Regarding the TRIAL within a TRIAL, the judge asked: “Is this the final witness, specifically regarding the admissibility of these statements? I ask because it is unclear whether the pointing-out evidence forms part of this or not. Initially, there were considerations to include it, but it has since become apparent that the address was already known to the police. Therefore, by agreement with counsel, the pointing-out will not be pursued in this trial.”
“So, Mr. van Rhyn, Mr. Appollis, I’m ordering that you be detained in the police cells tonight. They’re nearby, which will allow us to start promptly tomorrow morning. Also, you’re already running late for Malmesbury Prison — it’s past lock-up, past meal time, and the rest.
But don’t be concerned — Warrant Officer Nito will look after you. We’ll need to amend your warrants accordingly, so please proceed to the warrant office to have them updated.”
