Life Sentences Stand in Joshlin Smith Case

Cape Town:- The Western Cape High Court has denied the leave to appeal application of Racquel“Kelly”Smith, Jacquen“Boeta”Appollis,and Steveno van Rhyn. Affirming the life imprisonment plus 10-year sentences previously imposed for the kidnapping and trafficking of six-year-old Joshlin Smith.

The three had appeared in court seeking permission to challenge both their convictions and sentences. However, Judge Nathan Erasmus, who delivered the original sentencing, ruled there were no reasonable prospects of success, citing solid factual and testimonial evidence underpinning the original verdict .

Furthermore, the court reaffirmed that state witness Lourentia “Renz” Lombaard, whose testimony was pivotal, retains full indemnity from prosecution under Section 204 of the Criminal Procedure Act .

What This Means

The harsh sentences remain intact, confirming that yesterday’s concerns about disproportionate punishment in high-profile cases do not alter the legal outcome.

The convictions, based on overwhelming evidence, stand firm.

The NPA has stated it will oppose any further appeal efforts, including one at the Supreme Court of Appeal, and remains confident that no higher court will change the outcome .

This ruling underscores the gravity of child trafficking crimes and indicates that, in certain cases, sentencing does reflect the severity of the offence. Yet it continues to fuel questions about consistency within the broader justice system, especially in cases that capture national attention.
